Legal Help Needed! I hired a contractor & he hired a subcontractor!?

Okay I hired a contractor who realized he was not going to finish my store within the 6month time limit laid out in our contract so he hired a subcontractor with out my notification or agreement. I went by to do a once over & he work was horrible. I filed a lawsuit in the district court of Harris County petitioning the court for an injunction against both companies to stop on the project and suing the first company for breach of contract and specific performance. The first company is arguing that they had the right to delegate the duties of the contract and to discharge the contract due to commercial impracticability. Who do you think should win? Please Explain why? If possible use legal defense terms so that I may know what to research or what to say!!! Thanks Need Answers ASAP.
